Is the Supreme Court already a lost cause even without the addition of Kagan?

Just like pre-emptive war, guilty with no chance of proving innocence.

Court: No Need To Free 'Sexually Dangerous' Inmates

The most dangerous part of this is:
the "authority in allowing indefinite detentions of [those] considered [...] dangerous"

Which means the SCOTUS has set the precedent for the state to detain CITIZENS indefinitely "to maintain the security" of the general public. Though I have no particular good feelings for the people in question, it IS the slope in which entire classes of other people may be detained indefinitely without DUE PROCESS just as we have seen with "enemy combatants" (non-citizens) at Guantanamo or the recent Obama continuance of the CIA policy allowing assassination of US citizens, again without due process.

Habeas corpus - Originally a feature of English law, the writ of habeas corpus has historically been an important legal instrument safeguarding individual freedom against arbitrary state action.

First they came for the sexual predators... next they came for the political dissidents...
